Raffia Arshad has become one of the first Muslim woman in the UK to wear a hijab and be appointed as a judge – a Deputy District Judge
صدر قرار تعيينها نائبةً لقاضي في اخر مايو 2020 واعتلت منصة القضاء في منطقة “ميدلاندز” ببريطانيا.
درست القانون والمحاسبة والتمويل وتخرجت عام 2001. وتعد أول من التحق بالجامعة في عائلتها.
رافيا عضو في "St. Mary's Chambers" القانونية، التي تأسست عام 1999 التي تقدم استشارات قانونية. وأكد رؤساء أرشد في غرفة سانت ماري، أنها فتحت الطريق أمام النساء المـ///ــلمات للنجاح في القانون، وأكدوا على استحقاقها المنصب عن جدارة.
وتمتلك خبرة طويلة في مجال المحاماة لأكثر من 17 سنة وتخصصت خلال السنوات الماضية في قضايا تتعلق بالشريعة الإـ///ــلامية، بينها حماية الأطفال وقضايا الزواج القسري وختان الإناث، وأصدرت مؤلفا حول قانون الأسرة الإـ///ــلامي. لها كتب علي منصة أمازون كما سافرت للعديد من دول العالم تشارك بخبراتها القانونية.
She was appointed a deputy district judge on the Midlands circuit in May 2020.
Arshad graduated in law, accounting and finance from Oxford Brookes University in 2001. She was called to the bar a year later and joined St Mary’s, a national specialist in family law, in 2004.
After training in London Ms. Arshad was called in 2002 and joined St Mary’s Family Law Chambers in 2004.
Raffia has been practicing family law for over 17 years and is a barrister of St. Mary's Family Law Chambers on High Pavement. Throughout her career, she has practiced in a variety of fields including private law children, forced marriage, female genital mutilation, and cases with Islamic law issues.
District Judge Arshad was the first in her family to go to university and is the author of 'Islamic Family Law' – a topic she is considered by some as an expert in.
She joins a select group of Muslim female judges, with three First Tier Tribunal judges who also wear a hijab preceding Raffia in their appointments. Arshad has since acknowledged on Twitter that there are also two tribunal judges in the hijab.
She went on to have a successful career as a barrister, becoming the author of a leading text in Islamic Family Law.
تحدثت عنها الصحافة العالمية ومنصات التواصل الاجتماعي وتحدثت أرشد عن لحظة حاسمة في حياتها المهنية عام 2001 عندما أخبرها أحد أفراد الأسرة بعدم ارتداء الحجاب قبل الذهاب إلى مقابلة للحصول على منحة دراسية، قائلا إن ذلك سيؤثر بشدة على حظوظها، وقالت “قررت أنني سأرتدي الحجاب لأنه من المهم بالنسبة لي قبول الشخص على طبيعته، وإذا كان ينبغي أن أصبح شخصا مختلفا لمتابعة مهنتي، فهذا ليس ما أرغب فيه”.
وأوضحت أنها كانت في صغرها تخشى أن انتماءها للطبقة العاملة ولأقلية عرقية سيكون عاملا يسهم في استبعادها من هذه المهنة، مضيفة أنها تأمل أن يكون منصبها منبرا “لضمان إسماع صوت التنوع”
Ms. Arshad described a defining moment in her career in 2001 when a family member told her not to wear her hijab to an interview for a scholarship at the Inns of Court School of Law, saying it would severely affect her chances.
“I decided that I was going to wear my headscarf because for me it’s so important to accept the person for who they are and if I had to become a different person to pursue my profession, it’s not something I wanted,” she said.
“I think that was probably one of the most profound first steps in my career. It was a solid ‘yes, you can do this’,” she said.
Arshad told the newspaper that as a young girl she questioned whether a working-class woman from an ethnic minority background would succeed in law.
وتابعت أرشد أن قرار تعيينها يهدف إلى تعزيز التنوع، وأن المسؤولين عندما عيّنوها لم يعرفوا أنها محجبة، وقالت أرشد “أدرك أن هذا المنصب أكبر مني، ولا يتعلق فقط بي. إنه مهم لجميع النساء، وليس النساء المـ///ــلمات فحسب”قالت أرشد إن صورة في أحد المحاكم تظهر فيها امرأة من خلفية إثنية مختلفة ومكتوب عليها "هل فكرتِ في أن تصبحي قاضية؟"، وتابعت: "أنا الآن قاضية".وتأمل أن تكون مصدر إلهام للشباب المـ///ــلم. ووصفت ذلك بأنه «نبأ عظيم للتنوع في النظام القانوني في المملكة المتحدة الأكثر احتراماً في العالم».
وأوضحت أن خبر ترقيتها، الذي أبلغها به رئيس القضاة، كان خبراً ساراً لها، إلا أن سعادة الآخرين به كانت أكبر بكثير، ولفتت إلى أنها “تلقت الكثير من رسائل البريد الإلكتروني من رجال ونساء، بينهن محجبات أعربن عن اعتقادهن بأنهن لن يتمكن من أن يصبحن محاميات، فما بالك بتولي منصب قاض؟”.
She said “It’s definitely bigger than me, I know this is not about me. It’s important for all women, not just Muslim women, but it is particularly important for Muslim women,” adding that the positive reception she has received is the most rewarding aspect of her appointment. “I’ve had so many emails from people, men and women. It’s the ones from women that stand out, saying that they wear a hijab and they thought they wouldn’t even be able to become a barrister, let alone a judge.”
وأشارت إلى أنه على الرغم من أن المكتب القضائي ولجنة التعيينات في المملكة المتحدة يبذلان أقصى جهدهما لمحاربة التمييز والعنصرية، إلا أن القضاء بشكل عام لا يزال غير متنوع بما فيه الكفاية، مضيفة أنها تتعرض للعنصرية في بعض الأحيان بسبب الحجاب.
ولفتت إلى أنها تعرضت للتمييز بانتظام في المحكمة بسبب حجابها، وأن البعض اعتقد أنها عاملة بالمحكمة أو مترجمة أو صاحبة قضية، وقالت إنها لا تحمل شيئاً ضد من قال ذلك، لأن هذا يعكس رأي المجتمع، وأوضحت أن العاملين في المحاكم لا يزال لديهم هذا الرأي المتحيز.
Arshad told that she still encounters prejudice and discrimination in the courtroom. She described how she sometimes gets mistaken for a client, interpreter or someone on work experience, most recently by an usher.
“I have nothing against the usher who said that but it reflects that as a society, even for somebody who works in the courts, there is still this prejudicial view that professionals at the top end don’t look like me,” she said.
Ms. Arshad emphasized that while the judicial office is doing its utmost to promote inclusion, she carries her own sense of responsibility to champion diversity in the profession.
Raffia said: "This is an achievement not just for women, but for Muslim women.
"If there ever was a time to stand up and fulfill your professional aspirations, it is now."
‘Now it’s up to me to be that voice for them, to make sure the sound of diversity is heard loud and clear and that it gets to the appropriate places,” she said.
ونقلت هيئة الإذاعة البريطانية (بي بي سي) عن أرشد قولها، إنها كسرت “الصورة النمطية” لدى الكثيرين عن القضاة في بلادها. وأضافت: “وصولي إلى هذه النقطة استغرق بعض الوقت، لكنني ممتنة”، مشيرة إلى أن “نجاحها بمثابة نجاح لكل شخص من أصول مختلفة.
وأشارت أرشد إلى أنها تأمل من خلال خطوتها هذه إلى تشجيع الشابات المـ///ــلمات الأخريات في مهنة المحاماة على أن تحذو حذوها، وأن يصل صوت التنوع بشكل عالي وواضح إلى مختلف الأماكن.
بدوره، رأى مرصد الأزهر في بيان، أن تعيين أرشد خطوة إيجابية تسهم في نقل صورة إيجابية عن المـ///ــلمين في المملكة المتحدة، وهو انعكاس حقيقي لاندماج المـ///ــلمين داخل المجتمعات الغربية، لا سيّما المرأة المـ///ــلمة التي لم يمنعها حجابها من ممارسة حقوقها والوصول لمناصب رفيعة.
تنتمي رافيا لمنطقة بورتون – ترينت ببريطانيا. وتبلغ من العمر 40 عاماً وهي أم لثلاثة أولاد.
The joint heads of St Mary’s said that they were proud of Arshad’s achievement.
“Raffia has led the way for Muslim women to succeed in the law and at the bar and has worked tirelessly to promote equality and diversity in the profession. It is an appointment richly deserved and entirely on merit and all at St Mary’s are proud of her and wish her every success.” Vickie Hodges and Judy Claxton said.
Arshad will begin sitting part-time on the Midland circuit later this year, and will continue to practise from St Mary’s.
