النقاش الذي عرفته بعض المواقع الإلكترونية وشبكات التواصل الاجتماعي حول حقوق الإنسان، بمناسبة إعلان السلطة عن حالة الطوارئ الصحية، رافقه شعور جمعي بالحاجة إلى "قوة الدولة"، و"صرامتها" في تطبيق قرارها القاضي باحترام الحجر الصحّي من طرف الجميع، أي القوة الضابطة التي تمكن من خلق الفضاء العام المطلوب في ظرف معين لمصلحة الجميع.
وحدث على إثر هذا خلاف بين مواطنين وحقوقيين جعل البعض يعتقد بأن حقوق الإنسان موضوع مؤجل لا ينبغي إثارته في هذا الظرف، وهذا خطا فادح، إذ أن حقوق الإنسان ليست حقوقا ظرفية، بل هي ملازمة للإنسان في جميع أحواله وظروف معيشه اليومي، ولا توجد لحظات استثنائية يصبح فيها الإنسان أقل إنسانية ولا يستحق فيها حقوقه، إلا لحظات هدر الكرامة.
ولعل سبب طرح مشكل حقوق الإنسان في هذا الظرف بالذات هو سلوك بعض رجال السلطة الذين اضطروا إلى اللجوء إلى العنف لجعل بعض المواطنين يحترمون قرار الدولة، حيث ظهر أن البعض أعلن العصيان على القرار الرسمي بالحجر الصحي، وظهر بذلك مقدار ضعف الوعي المواطن والتفكير العقلاني والواقعي عند كثير من الناس.
ومن تمّ وجب التدقيق التالي:
إن الحجر الصحّي الذي أعلنته الدولة ليس انتهاكا لحقوق الإنسان ولا اعتداء على المجتمع، بل هو قرار من أجل مصلحة الكل، إذ لا حلّ في غياب لقاح فعال إلا بهذا الحجر، ويدخل هذا ضمن ما يسمى "علة الدولة" أو La raison d’état ، الذي يعطيها الحق في استعمال القوة المشروعة من أجل مصلحة المجتمع.
والتزام المواطنين بقرار الدولة هو تنازل حكيم وإرادي عن حريتهم في التنقل لكنه ليس تنازلا أبديا، بل هو محدود باستمرار الوضعية المشكلة، وعلى الدولة القيام بحملات تحسيس مكثفة في هذا الاتجاه، حيث من الخطأ مطالبة الناس بالمكوث في بيوتهم دون توضيح أن ذلك ليس مسا بحقهم المبدئي في التنقل، ولكنه إجراء مؤقت تفرضه ظروف قاهرة، وكذلك دون توفير شروط العيش الكريم لهم وخاصة العائلات المعوزة.
من جانب آخر على السلطة التعامل مع المواطنين "العصاة" بمنطق القانون، والذي هو الاعتقال والمحاكمة طبقا للنص الذي صادق عليه البرلمان، ولكن ليس من حق رجال الأمن أن يتجاوزوا حدود ذلك، حيث أنّ الضرب والتنكيل والعنف غير المبرّر يُعدّ انتهاكا للقانون ولحقوق المواطنين المخطئين، والذين ينصّ القانون على معاقبتهم بالسجن والغرامة في إطار المساطر المعمول بها، لا على إهانتهم أو سوء معاملتهم.
ولم أجد في هذا الصدد أبلغ ولا أوضح من خطاب السيدة ميركيل التي توجهت إلى الشعب الألماني بالعبارات البليغة التالية:
"أعرف مدى صعوبة عمليات الإغلاق من الحكومات على حياتنا وصورتنا الديمقراطية، هذه قيود لم نشهد مثلها من قبل في ألمانيا، ودعوني أؤكد لكم بالنسبة لشخص مثلي حارب جاهدا للحصول على حقوق وحرية التنقل والسفر، أنني لم أكن لأقبل بهذه القيود لولا أهميتها وضرورتها القصوى، ولا يمكن وضع هكذا قيود في دولة ديمقراطية بسهولة، وسيتم إقرار هذه القيود بشكل مؤقت فقط، لكن لا غنى عنها الآن لإنقاذ الحياة. نحن بلد ديمقراطي لا نعيش على الإكراه، ولكن بالمعرفة والمشاركة، وهذه مهمة تاريخية لا يمكن تحقيقها إلا معا. يمكننا قبول القيود الحالية والتضامن مع بعضنا البعض، هذا الوضع جدّي ومفتوح وهذا يعني أننا سنعتمد بشكل أساسي على كيفية التزام كل شخص باتباع القواعد وتنفيذها، وعلينا أن نثبت أننا نتصرف بحبّ وعقلانية حتى ننقذ الأرواح".
