“Women Judges in Egypt” article in September 2019 in the Japanese newspaper “Yomiuri”

"تكفل الدولة حق المرأة في التعيين في كافة الجهات والهيئات القضائية دون تمييز ضدها" تقول أمنية جادالله المدرس المساعد بكلية الشريعة والقانون – جامعة الأزهر بالقاهرة (أمنية) ( 28 عام) المادة 11 من الدستور المصري. "ورغم ذلك، لا يمكن للنساء حتى التقدم لاعتلاء منصة المحكمة".
تخرجت قبل 6 سنوات من كلية القانون والشريعه بجامعة الأزهر العريقة في مصر،بتقدير امتياز مع مرتبة الشرف وحصلت على المرتبة الثانية بين الخريجات. "أحلم بدولة عادلة قائمة على سيادة الدستور والقانون وتحقيق العدالة" وقررت أن أصبح قاضيا. عندما ذهبت لاستلام طلب التقديم لاعتلاء منصة القضاء، وحتي أتمكن من أداء اختبار التوظيف للقبول بالمحكمة ، تم صدّي من الموظف المسئول قائلا "غير مسموح للنساء بالتقديم للقضاء". "لقد درست بجد وتفوقت على طلاب كثر، فلماذا التمييز دون اي اعتبار موضوعي على أساس الجنس خلافا لمعيار الكفاءة … "تقول أمنية.
"The state guarantees the right of women to be appointed at judicial institutions." Al-Azhar University Assistant Lecturer Omnia (28 years), read Article 11 of the Egyptian Constitution. “Despite that, women still can't even apply to sit on the bar”.
6 years ago, I graduated from Egypt's prestigious Al-Azhar University School of Law and Shari’a, with the grade of excellent and honor, ranked second among 100 women. "I want to live in country based on the rule of law and justice" and decided to become a judge. When I went to get the application and submit my documents to take the court recruitment examination, I was repulsed at the window saying "Women are not accepted". “I studied hard and was better than many other students. Why does discrimination take a place …”.
رفعت الدكتورة أمنية دعويان أمام القضاء تطالب فيها بقبول طلبها اعتلاء المنصة، لأنه من غير الدستوري حرمان المرأة من حقوقها ومنعها من تولي القضاء. أشار حكم المحكمة الإدارية العليا في الدعوى الأولى، الصادر قبل عامين في حقها، إلى أن "السلطة القضائية هي التي تقرر من يتم تعيينه من عدمه، واعلان الوظيفة القضائية موجه للخريجين فقط دون الخريجات"، وفقدت أمنية الأمل في الدعوى الأولي.
من حيث المبدأ، لا يُسمح للنساء في مصر والسعودية بتعيين القاضيات والمدعين العموميين. ومن الأسس التي يتم الاستناد عليها هي أن المرأة عاطفية بطبعها وأنها "ناقصة عقل ودين". يقول قاض من الذكور في شمال مصر (64 عام): "تنتاب النساء مشاعر متباينة أثناء الظرف الشهري لهن، ويوجد دليل قاطع من طبيعة النساء أنفسهن. تولي القضاء للنساء مستحيل"
Ms. Omnia filed 2 lawsuits requesting acceptance of an application because it was unconstitutional that a woman could not be a judge. The decision of the Supreme Administrative Court, issued two years ago, indicated that “It is the judicial authority that decides to hire”, and Omnia lost.
In principle, women in Egypt and Saudi Arabia are not allowed to be employed as judges and prosecutors. The grounds vary and some refer it religious Islamic grounds and that "women are not rational". A male judge in northern Egypt (64) said, “Women are disgusted during menstruation, and there is no terrible evidence such as photographs of their bodies. Judgeship is impossible for women.”.
تقول الدكتورة "هدى بدران" رئيس الاتحاد العام لنساء مصر بالقاهرة ، قالت: "تميل محاكمات الشرق الأوسط إلى أن تكون ضد النساء"، وأشارت إلى عدم وجود قاضيات في تشكيل المحكمة. فمثلا في حالات الاغتصاب ، هناك حالات يتم فيها تخفيف عقوبة المتهمين بسبب التعويل على ملابس وسلوك النساء.
في مصر ، في السنوات الأخيرة ، تم تعيين حوالي 66 مصرية كقاضية، بخلاف الطريق الطبيعي المنتظم في المحاكم. يبدو أن هذا يمنع النقد من الداخل والخارج ، لكن نسبة القضاة الإناث أقل من 1٪.
”Cairo women group representative Dr. Hoda Badran (78 years) said,“ Middle East trials tend to be against women, ”and pointed out the lack of female judges as a background. In the case of rape, there are cases where defendants' sentence is lightened because of problems with women's clothing and behavior”.
In Egypt, in recent years, approximately 66 women, including officials from semi- judicial institutions, have been abnormally appointed as judges, through a different track from regular employment process for the courts. This seems to fend off critics nationally and internationally. However, the percentage of women judges is less than 1%.
